The Fifth Circuit Just Says No to Vaccine Mandates

Can a federal court of appeals stay something before it starts?

The answer is no, according to the legal experts who seemed to bloom on media platforms in response to the court’s action like a Lilly of legal persuasion.

They assert that unless the law or the Constitution forbids some portion of the Biden vaccine mandates, those mandates will proceed.

However, the Fifth Circuit states that “The presidential order raises grave statutory and constitutional issues.”

The mandate ought to cause health concerns.

The Labor Department said on Thursday that owners of companies with a minimum of one hundred employees must ensure that each of them is vaccinated.

That requirement faces challenges from a squad of GOP state attorneys generals as well as from private employers.

According to the Labor Department, the power to enforce the rule derives from the Occupational Health and Safety Act.

They say OSHA empowers the Biden Administration via OSHA to prevent worker endangerment in a health crisis.
